SETTLEMENT OF GOODS, IMPORTED AND EXPORTED BY POST

THE DIRECTOR GENERAL OF CUSTOMS AND EXCISES AND
THE DIRECTOR GENERAL OF POST AND TELECOMMUNICATION,

Considering:

that in the framework of improving the services and protection of the public interests as well as the protection of the state financial incomes, it is necessary to stipulate a provision on the settlement of goods imported and exported by post.

In view of:

• 1. Law No. 6/1984 on Post (Statute Book of 1994 No. 28, Supplement Statute Book No. 3278);
• 2. Law No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement Statute Book No. 3612):
• 3. Law No. 11/1995 on Excises (Statute Book of 1995 No. 76, Supplement Statute Book No. 3613);
• 4. Decree of the Finance Minister No. 325/KMK.01/1989 on the stipulation on the value of the provision on the management of goods imported and exported by post as amended by Decree of the Finance Minister No. 439/KMK.03/1996 dated June 21, 1996;
• 5. Decree of the Finance Minister No. 825/KMK.00/1990 on the Entry and Exit to and from Bonded Zones in the Industrial Region of Batam Island;
• 6. Decree of the Finance Minister No. 232/KMK/05/1996 on Procedures for the Payment and Depositing of Customs, Excises, Administrative Fines, Interest and Tax in the framework of Import;
• 7. Decree of the Finance Minister No. 235/KMK.05/1996 on Goods Declared not Authorized, Goods Authorized by the State and Goods Owned by the State;
• 8. Decree of the Finance Minister No. 490/KMK.05/1996 on Procedures for Import of Passenger Goods, Crew of Transporting Means, Border Crossers, Post Delivery and Delivery by Mailing Companies;
• 9. Decree of the Finance Minister No. 488/KMK.05/1996 on Procedures for Customs on Export as amended by Decree of the Finance Minister No. 501/KMK.05/1999;
• 10. Decree of the Finance Minister No. 291/KMK.05/1991 dated June 26, 1997 on Bonded Zones;
• 11. Decree of the Communication Minister No. KM 86/1999 dated October 14,1999 on the Management of Non-Standard Post Package Services;

DECIDE:

To stipulate:

JOINT DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISES AND THE DIRECTOR GENERAL OF POST AND TELECOMMUNICATION ON THE SETTLEMENT OF GOODS IMPORTED AND EXPORTED BY POST.

Article 1

(1) The settlement of goods imported and exported by post through the state post company of PT Pos Indonesia and the Director General of Customs and Excises.

(2) The settlement as meant in sub-article (1) covers the management of post bags, the imposition of customs for goods imported and exported by post and their supervision.

(3) The Settlement of goods exported by post from Bonded Zones in the Industrial Region of Batam Island sent to other Indonesian custom areas and the settlement of goods imported or exported by post sent, by using Express Mail Service will be separately regulated.

Article 2

The settlement of goods imported and exported in the form of cargo sent by PT Pos Indonesia, is done by PPJK Pos Indonesia in accordance with the existing provision.

Article 3

(1) Goods imported and exported by post are inspected by Customs and Excises Officials.

(2) Goods imported and exported as meant in sub-article (1) needs selective physical inspection by Custom and Excise Officials witnessed by Post Officers.

Article 4

The implementation of the this Joint Decision is further regulated by the Director General of Customs and Excises and the Director General of Post and Telecommunication both jointly or individually.

Article 5

With this Joint Decision effective, so Joint Decision of the Director General of Customs and Excises and the Director General of Post and Telecommunication No. KEP-80a/BC/1997 and No. 208/DIRJEN/1997 dated October 6, 1997 on the Settlement of Goods Imported and Exported by Post is declared not effective.

Article 6

This decision starts to be effective as from the date of stipulation.
